In consideration of the undersigned being permitted to engage in any activity, recreational or otherwise, on the property including without limitation any building, parking area, sidewalk, porch, pavilion, staircase, trail, range, bay and land, owned, leased, used, or accessed by ACE Tomato Company, LLC and Ozark Dynamics, LLC , and each of their successors and assigns, including without limitation to property located at 191 Shamrock Lane, Gassville, Arkansas 72635 (collectively the Premises), the undersigned and the undersigned heirs, family members, guests, executors, administrators, personal representatives, successors, and assigns (collectively the Undersigned) hereby understands, acknowledges, and agrees to the following:

1. The undersigned hereby acknowledges and agrees to have voluntarily applied to use the shooting range and facilities owned by ACE Tomato Company, LLC and operated by Ozark Dynamics, LLC.  It is understood and acknowledged that the use of a live fire shooting range in which others, as well as the Undersigned, are engaged in shooting activities involves inherent extreme hazards, dangers, and risks.  The Undersigned represents that he/she is fully competent to participate in training, shooting, and competitive activities and that he/she freely, knowingly, and voluntarily assumes the risk of property damage, bodily harm, and death.  The Undersigned acknowledges, understands, and will follow the posted and printed Range Safety Rules.

2. The Undersigned does for himself/herself, and on behalf of his/her heirs, executors, administrators, partners, agents, brokers, insurers, and assigns, hereby release, acquit, indemnify, and hold harmless ACE Tomato Company, LLC and Ozark Dynamics, LLC, all of its officers, directors, owners, partners, agents, brokers, employees, contractors, insurers, assigns, and all other related people, entities, affiliates, predecessors, and successors, from any and all claims, actions in law or equity, causes of actions, demands, rights, damages, costs, loss of services, expenses, and compensation whatsoever arising from any injury, damage to property, injury to person, or death (whether predicated upon negligence or otherwise) in connection with ACE Tomato Company, LLC and Ozark Dynamics, LLC or participation in any activities therein.  The Undersigned takes full legal and financial responsibility for any damage or harm to themselves, other individuals, rental equipment, range property, or other range equipment that is a result of the actions of the Undersigned, and received party, and/or any other individual/entity on the Premises.

3. The Undersigned affirms that he/she is not under the influence of alcohol or drugs (legal, prescription, or otherwise) while on property owned, rented, leased, or controlled by ACE Tomato Company, LLC and Ozark Dynamics, LLC.  Consumption of drugs and/or alcohol while on the Premises is strictly and expressly prohibited.

4. By signing this instrument, the Undersigned affirms that he/she has read, understands, and will comply with the requirements set herein and do hereby agree to defend, indemnify, and hold harmless ACE Tomato Company, LLC and Ozark Dynamics, LLC, and its officers, directors, owners, contractors, partners, agents, brokers, employees, insurers, assigns, and all other related people, entities, affiliates, predecessors, and successors, from any act or omission for which the Undersigned is directly responsible.  This instrument binds the undersigned and his/her executors, administrator, assignees, or heirs.
